What is EFCA?

The Employee Free Choice Act would take away employee’s rights to secret ballot elections. Elections that determine if they want to be represented by a union. With EFCA, if a majority of employees sign union authorization cards, EFCA requires employers to bargain with a union, with no notice of an ongoing union campaign.

Another provision of EFCA would require arbitration of a first contract if the company and the union are unable to reach agreement within 120 days. In such cases, a labor agreement imposed by the arbitrator would bind the parties for two years. This requirement could expose employers to perhaps intolerable obstacles to conducting business successfully.
